PowerCut Terms of Service

Welcome to PowerCut.

PowerCut is an AI-powered video editing platform that enables users to transform long-form video content into short, social-media-ready clips through automated analysis, transcription, and editing tools, and to schedule and publish those clips to social media accounts they connect.

These Terms of Service ("Terms") govern your access to and use of the PowerCut website, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

PowerCut is a browser-based software platform that assists users in:

• Automatically identifying engaging segments within long-form video content
• Editing video clips through a web-based timeline editor
• Removing filler words and pauses using transcript-based editing
• Adding captions and formatting clips for social media platforms
• Exporting finished video clips
• Scheduling and publishing clips to social media accounts you connect

PowerCut provides tools that assist with editing, but users remain responsible for the content they upload and distribute.

You must be at least 18 years old to use the Service.

By using PowerCut, you represent and warrant that:

• You have the legal capacity to enter into these Terms.
• You will comply with all applicable laws and regulations.

To access certain features of the Service, you may be required to create an account.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

Payments for subscriptions or services are processed through our payment partner Paddle, which acts as the Merchant of Record for transactions.

When you purchase a subscription:

• Your payment will be charged by Paddle.
• Paddle will appear on your billing statement.
• Paddle's terms and privacy policy may also apply to payment transactions.

Subscription plans may be billed on a recurring basis (monthly or annually), depending on the plan selected.

You authorize Paddle to charge your selected payment method for all applicable fees.

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.

You may cancel your subscription at any time through your account dashboard.

Cancellation will take effect at the end of the current billing period.

Due to the digital nature of the Service, subscription payments are generally non-refundable.

However, refunds may be issued in limited circumstances at our discretion or where required by law.

Refund requests should be submitted through our support contact.

Users may upload video, audio, text, or other materials ("User Content") to the Service.

You retain ownership of your User Content.

By uploading content, you grant PowerCut a limited license to:

• Process
• Store
• Analyze
• And display the content

solely for the purpose of providing the Service.

You represent and warrant that you have the necessary rights to upload and use the content.

You can connect accounts on third-party platforms, such as YouTube, and ask PowerCut to publish content to them for you at a time you choose.

By connecting a YouTube account, you agree to be bound by the YouTube Terms of Service at https://www.youtube.com/t/terms. Your use of any other platform is governed by that platform's terms.

By connecting an Instagram or Facebook account, you agree to be bound by the Meta Terms of Service at https://www.facebook.com/terms.php and the Instagram Terms of Use at https://help.instagram.com/581066165581870. Publishing to Instagram requires a professional (Business or Creator) account, and publishing to Facebook requires a Page you manage; these are Meta's requirements, not ours. PowerCut is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.

You authorize PowerCut to upload the content you schedule, with the titles, captions, and settings you choose, to the accounts you select.

You are responsible for the content you publish and for complying with each platform's terms, policies, and community guidelines, including any requirement to disclose paid promotions.

Platforms may reject, limit, or remove content, and may change or withdraw access to their services. We do not guarantee that a post will be published, or published at a specific time.

You can disconnect an account at any time. Scheduled posts for that account are then cancelled; posts already published remain on the platform.

You agree not to use the Service to:

• Upload copyrighted content without permission
• Violate any intellectual property rights
• Upload illegal, abusive, or harmful material
• Interfere with the operation of the Service
• Attempt to reverse engineer or exploit the platform
• Publish content that violates the terms or policies of the platforms you publish to

PowerCut reserves the right to suspend or terminate accounts that violate these rules.

PowerCut strives to maintain reliable service but does not guarantee uninterrupted availability.

The Service may occasionally be unavailable due to:

• Maintenance
• Infrastructure issues
• Third-party service disruptions

We reserve the right to modify or discontinue features at any time.

The PowerCut platform, including its software, design, branding, and features, is the property of PowerCut and its licensors.

You may not copy, modify, distribute, or create derivative works based on the Service without permission.

To the maximum extent permitted by law, PowerCut shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service.

Our total liability for any claim shall not exceed the amount paid by you for the Service during the previous 12 months.

We may suspend or terminate your access to the Service if:

• You violate these Terms
• Your use of the Service poses legal or operational risk

You may terminate your account at any time.

We may update these Terms periodically.

When we do, the updated version will be posted on our website with a revised "Last Updated" date.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
